Definition
The Malta Gaming Authority (MGA) is the primary regulatory body for gaming activities in Malta and is widely regarded as the most prestigious gambling regulatory jurisdiction within the European Union. Established under the Remote Gaming Regulations 2004 and reformed by the Gaming Act (Chapter 583 of the Laws of Malta) in 2018, the MGA issues B2C (business-to-consumer) licences for operators accepting players directly and B2B (business-to-business) licences for companies supplying critical gaming software or services to MGA-licensed operators.
Malta's EU membership means MGA-licensed operators benefit from EU treaty freedoms, facilitating payment processing, software procurement, and corporate structuring across the EU/EEA.
The MGA licensing framework distinguishes between two core B2C licence types: the B2C Gaming Service Licence, permitting operators to offer online casino games, sports betting, poker, and other gaming services; and the B2B Critical Gaming Supply Licence for providers of gaming platforms, RNG-certified games, and critical operational systems. The B2C application process requires submission of a full business plan, corporate structure diagram, source-of-funds declaration, background checks on ultimate beneficial owners (UBOs) and key function holders (KFHs), and technical compliance certification from an approved test house (BMM, eCOGRA, iTech Labs).
Processing time for a full B2C licence is typically 4–9 months, with an initial licence term of 10 years renewable subject to annual compliance reviews.
MGA licence fees comprise multiple components: a non-refundable application fee of €5,000; an annual compliance contribution calculated on gross gambling revenue (GGR), ranging from €25,000 per licence type per year; and technical audit fees. Operators must maintain minimum capitalisation of €100,000 for most B2C categories, segregate player funds in protected accounts, and maintain physical substance in Malta - including locally-based key function holders covering compliance, AML, and responsible gaming functions.
For affiliates and operators commercially, the MGA designation functions as a quality signal. Payment processors, banking partners, and software suppliers give preferential terms to MGA-licensed entities compared to offshore alternatives.
Many affiliate networks mandate MGA or equivalent white-listed licences as a prerequisite for programme membership. In grey-market jurisdictions where local regulation is absent, the MGA licence is accepted by players as a credible trust indicator.
Affiliates promoting MGA-licensed operators can display the MGA seal in marketing materials, subject to MGA's affiliate registration requirements.
